Terms and condition for accommodation contracts

(Scope of Application)
Article 1.

  1. Contracts for accommodation and related agreements to be entered into between this Facility and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided herein shall be governed by laws and regulations and/or generally accepted practices.
  2. In the case when the Facility has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices the special contract shall take precedence over the provisions of these Terms and Conditions, notwithstanding the preceding Paragraph.

(Application for Accommodation Contract)
Article 2.

  1. A Guest who intends to make an application for an Accommodation Contract with the accommodation shall notify the Facility of the following particulars:
    1. Name of the Guest(s).
    2. Date of accommodation and estimated time of arrival.
    3. Accommodation charges (based in principle on the Basic Accommodation Charges listed in the Attached Table No. 1).
    4. The number of guests (even infants who do not need to pay the accommodation fee, must make an offer. Also, if there is a change in the number of guests, a request must be made as soon as possible.).
    5. Other particulars deemed necessary by the Accommodation.
  2. In principle, even if a guest requests to continue the stay beyond the date of stay set forth in the preceding paragraph during the stay, continuous use is not accepted.

(Conclusion of Accommodation Contracts, etc.)
Article 3.

  1. A Contract for Accommodation shall be deemed to have been concluded when the Accommodation has duly accepted the application as stipulated in the preceding Article. However, the same shall not apply where it has been proved that the Accommodation has not accepted the application.
  2. If this facility presents an incorrect accommodation rate on an internet site or informs you of an incorrect accommodation rate over the phone, and if you apply for an accommodation rate based on the accommodation rate and the hotel accepts the accommodation rate, the applicable rate will be refunded. is significantly cheaper than the accommodation fees for the period before and after that period. If the price is ''limited'', ''special'', ''campaign'', etc., and the price is not displayed or provided, the accommodation contract is invalid because the acceptance is based on a mistake under civil law. We will promptly notify you of this.

(Refusal of Accommodation Contracts)
Article 4.

  1. The Accommodation may not accept the conclusion of an Accommodation Contract under any of the following circumstances:
    1. When the application for accommodation does not conform with the provisions of these Terms and Conditions.
    2. When the Accommodation is fully booked and there is no vacancy.
    3. When the accommodation is applied in excess of the maximum number of guests at this facility.
    4. When the Guest seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate laws or act against the public order or good morals in regard to his/her accommodation.
    5. When the Guest seeking accommodation can be clearly identified as carrying an infectious disease.
    6. When a burden beyond reasonable limits in relation to accommodation is asked.
    7. When the Guest is a gang member, gang group semi-regular member or gang member related persons and other antisocial forces.
    8. When the person requesting accommodation is a member of an organized crime group, or a related party.
    9. When a corporate body has related persons to gang members.
    10. When the person requesting accommodation is obviously intoxicated and could cause annoyance to other guests or when the person is behaving in such a manner as to be an annoyance to other guests.
    11. When the Accommodation and/or Accommodation staff are violently threatened or unreasonably burdened by the Guest.
    12. When the Accommodation is unable to provide accommodation due to natural calamities, malfunction of facilities and/or other unavoidable causes.
    13. When falling under the provisions of Article 5 of the Enforcement Ordinance of the Wakayama Prefectural Hotel Business Act.

(Right to Cancel Accommodation Contracts by the Guest)
Article 5.

  1. The Guest is entitled to cancel the Accommodation Contract by notifying the Accommodation.
  2. If the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable, the Guest shall pay cancellation charges as listed in the Attached Table No. 2.
  3. If the Guest does not appear by 8:00 p.m. of the accommodation date without advance notice (2 hours after the expected time of arrival if the Accommodation is notified), the Accommodation may regard the Accommodation Contract as being cancelled by the Guest.

(Right to Cancel Accommodation Contract by the Accommodation)
Article 6.

  1. The Accommodation may cancel the Accommodation Contract under any of the following circumstances:
    1. When the Guest is deemed liable for conduct and/or has conducted himself/herself in a manner that will violate laws or act against the public order and good morals in regard to his/her accommodation.
    2. When the Guest seeking accommodation can be clearly identified as carrying an infectious disease or fever of 37.5 degrees or more.
    3. When the HoteAccommodation is unable to provide accommodation due to natural calamities and/or other causes of force majeure.
    4. When a burden beyond reasonable limits in relation to accommodation is asked.
    5. When the Guest is a gang member, gang group semi-regular member or gang member related persons and other antisocial forces.
    6. When crime groups or crime members are associates of corporations or other bodies to control business activities.
    7. When a corporate body has related persons to gang members.
    8. When the person requesting accommodation is obviously intoxicated and could cause annoyance to other guests or when a person is behaving in such a manner as to be an annoyance to other guests.
    9. When the Accommodation and/or Accommodation staff suffers from violent threat or unreasonable burden from the Guest.
    10. When the Guest does not observe prohibited actions such as smoking in bed, tampers with fire-fighting facilities and otherwise breaches Accommodation Regulations stipulated by the Accommodation (restricted to particulars deemed necessary in order to avoid causing fires).
    11. When falling under the provisions of Article 5 of the Enforcement Ordinance of the Wakayama Prefectural Hotel Business Act.
  2. If the Accommodation has canceled the Accommodation Contract in accordance with the preceding Paragraph, the Accommodation shall not charge the Guest for any of the services during the contractual period he/she has not received.

(Registration)
Article 7.

  1. The Guest shall register the following particulars the Front Desk of the Facility on the day of accommodation:
    1. Name, age, sex, address and occupation of the Guest(s).
    2. Nationality, passport number, port and date of entry in Japan.
    3. Date and estimated time of departure.
    4. Other particulars deemed necessary by the Accommodation.
  2. All Guests of foreign nationality who do not reside within Japan will be asked to leave a photocopy of their passport with the Front Desk.
  3. In the case where the Guest intends to pay his/her accommodation charges prescribed in Article 11 by any means other than Japanese currency, such as traveler's cheque coupons or credit cards, these credentials shall be shown in advance at the time of the registration prescribed in the preceding Paragraph.

(Occupancy Hours of Guest Rooms)
Article 8.

The Guest is entitled to occupy the contracted guest room of the Accommodation from 3:00 p.m. on the day of arrival to 10:00 a.m. on the day of departure.

However, in the case when the Guest is accommodated continuously, the Guest may occupy the guest room all day, except for the days of arrival and departure. In addition, if the availability time of the facilities varies depending on the accommodation plan, it will be in accordance with each plan.

(Observance of Accommodation Regulations)
Article 9.

The Guest shall observe the Accommodation Regulations established by the Accommodation. Accommodation Regulations are posted within the premises of the Accommodation.

(Observance of Business Hours)
Article 10.

  1. The business hours of the Accommodation main facilities are as follows, and those of other facilities, etc. shall be notified in detail by brochures as provided in guest rooms and other means.
    ・Customer Support Center: Open 24 hours (All Day)
  2. The business hours specified in the preceding Paragraph are subject to temporary changes due to unavoidable circumstances of the Accommodation. In such cases, the Guest shall be informed by appropriate means.

(Payment of Accommodation Charges)
Article 11.

  1. The explanation of accommodation charges, etc. that the Guest shall pay is as listed in the attached Table No. 1.
  2. Accommodation charges, etc. as stated in the preceding Paragraph shall be paid during the reservation, at check-in or upon request by the Accommodation in Japanese currency. Other means acceptable to the Accommodation are traveler's cheques, coupons and credit cards.
  3. Accommodation charges shall be paid even if the Guest voluntarily does not utilize the accommodation facilities provided for him/her by the Accommodation.

(Liabilities of the Accommodation)
Article 12.

  1. The Accommodation shall compensate the Guest for damage if the Accommodation has caused such damage to the Guest in the fulfillment or the nonfulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in cases where such damage has been caused due to reasons for which the Accommodation is not liable.
  2. The Accommodation is covered by Accommodation Liability Insurance to deal with unexpected fire and/or other disasters.

(Handling when Unable to Provide Contracted Rooms)
Article 13.

  1. The Accommodation shall, when unable to provide contracted rooms, arrange accommodation of the same standard elsewhere for the Guest insofar as practicable with the consent of the Guest.
  2. When arrangement of other accommodation can not be made, notwithstanding the provisions of the preceding Paragraph, the Accommodation shall pay the Guest a compensation fee equivalent to the cancellation charges and the compensation fee shall be applied to reparations. However, when the Accommodation cannot provide accommodation due to causes for which the Accommodation is not liable, the Accommodation will not compensate the Guest.

(Handling of Deposited Articles)
Article 14.

The Accommodation will not compensate the Guest for damages when loss, breakage or other damage is caused, unless through intent or negligence on the part of the Accommodation, to the goods, cash or valuables brought onto the premises of the Accommodation by the Guest.

(Custody of Baggage and/or Belongings of Guest)
Article 15.

  1. When the baggage or belongings of the Guest are found after check-out and ownership of the article is confirmed, the Accommodation shall inform the owner of the article left and ask for further instructions. When no such instructions are given to the Accommodation by the owner or when ownership is not confirmed, the Accommodation shall handle it according to the Lost Goods Act.
  2. The Accommodation's liability in regards to the custody of the Guest's baggage and belongings in the case of the preceding Paragraph 1, the Accommodation shall compensate the Guest for damages when loss, breakage or other damage is caused, through intent or negligence on the part of the Accommodation. However, for articles of which the nature and value has not been reported in advance by the Guest, the Accommodation shall compensate the Guest up to a maximum of 150,000 yen.

(Liability in Regard to Parking)
Article 16.

The Accommodation shall not be liable for the custody of the vehicle of the Guest when the Guest utilizes the parking lot within the premises of the Accommodation, as it shall be regarded that the Accommodation simply offers the space for parking, whether the key of the vehicle has been deposited to the Accommodation or not. However, the Accommodation shall compensate the Guest for damage caused through intent or negligence on the part of the Accommodation in regards to the management of the parking lot.

(Liability of the Guest)
Article 17.

  1. The Guest shall compensate the Accommodation for damage caused through intent or negligence on part of the Guest.
  2. Damage and contamination of furniture, bedding, equipment, etc. will be charged the same as the new product, and regardless of the reason for the contamination of furniture, bedding, equipment, etc. due to vomiting, etc. will be charged 50,000 yen. In addition, if it is malicious, we may report it to the police.
  3. If you use property managed by this facility other than provided or loaned items based on the plan, etc. without consent, you will be charged the same fee for a new item.
  4. If there are any leftovers such as large garbage such as suitcases and strollers that cannot be disposed of as ordinary garbage (which means that the guest intentionally left them at our facility), it will be dealt with according to Article 15. If the owner wishes to be taken care of from our side, extra charge for the disposal cost will be required.

(Jurisdiction and Applicable Laws)
Article 18.

Litigation arising from the Terms & Conditions for Accommodation Contract will be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance. and in accordance with Japanese law.

(Changes to the accommodation agreement)
Article 19.

  1. In accordance with the 4 Paragraph 1 of Article 548 of the Civil Code, this facility may change these terms and conditions without the consent of the guests.
  2. If the institution changes the contents of these Terms and Conditions, it shall make known when the changes will take effect,the details of the changes and when they take effect through the Internet or other appropriate means.
  3. In cases where a guest has used the facility or has not taken the procedure for cancellation of the reservation within the period specified by the facility after the change was made known pursuant to the preceding paragraph, the user shall be deemed to have agreed to the change of the accommodation agreement.

Remarks:
1)The percentages signifies the cancellation charge to the Basic Accommodation Charges.
2)When the number of days contracted are reduced, cancellation charges for the first day shall be paid by the Guest regardless of the number of days shortened.
3)If the contract has its own penalty, the penalty set in the contract will apply.
